Cancelled Sales of New Vehicles/Withdrawals of Applications

When the sale of a new vehicle is cancelled after a customer has applied for a Title, but before the vehicle has been delivered, the Title application and Certificate of Origin may be withdrawn by RMV Service Centers and Electronic Vehicle Registration (EVR) program dealerships according to the procedures specified in this section.

 

An Application for Withdrawal of Title for New Vehicle may only be processed for a new vehicle. In order to qualify for a withdrawal, a Title application must meet all of the following criteria: 

      The vehicle must be a "new" vehicle. "New" is defined as a vehicle that has never been titled and has been issued a Certificate of Origin

      The customer never took delivery of the vehicle (i.e., the vehicle never left the dealer's premises)

 

A dealer may request to cancel or withdraw the Title application at a service center on the same day the application is submitted.

 

If the dealer requests to cancel or withdraw the Title application after the day of the application, the Application for Withdrawal of Title (and lien release, if there was a lienholder on the application) must be forwarded directly to the Title Division.

 

Because sales/use tax was collected at the time of the Title application, a purchaser or dealer may apply for a refund of the sales/use tax. For more information, please see the Refunds for Withdrawals of Sales page in the Massachusetts Sales and Use Tax Requirements section.

 

Once the Certificate of Title has been issued a withdrawal cannot be processed.

 

Withdrawals via the Electronic Vehicle Registration (EVR) Program

Dealerships participating in the Electronic Vehicle Registration Program are able to withdraw Title applications before paperwork is sent to the Title Division for processing. In order to qualify for a withdrawal from a dealership, a Title application must meet ALL of the following criteria:

      The vehicle must be a "new" vehicle. "New" is defined as a vehicle that has never been titled and has been issued a Certificate of Origin

      The customer never took delivery of the vehicle (i.e., the vehicle never left the dealer's premises)

      The Title application paperwork is still at the dealership

 

To process a Title withdrawal from a dealership participating in the Electronic Vehicle Registration program, the dealer must follow the instructions detailed below:

1.  Contact the Service Provider Helpline to inform them that a withdrawal needs to be processed. The Service Provider Helpline will then contact the Registry

2.  The dealer will be instructed to fax the following documents to the Registry:

RMV-1 Form

Application for Withdrawal of Title

Lien release if necessary

The dealer must include the dealership name, telephone number, and contact person on the fax header sheet

3.  The Registry will withdraw the transaction and cancel the plates if applicable

4.  The Registry will contact the dealership and inform them that the withdrawal has been completed. If the plates were cancelled, the plate return receipt will be mailed to the dealership

5.  The dealership must attach the following documents to the RMV-1 Form to be sent with the daily paperwork to the Title Division:

Application for Withdrawal of Title

An original lien release (if required). Faxes or photocopies are not acceptable

Notation on the Batch Header Sheet that the application has been withdrawn

Cancelled plates (enclose the actual plates) *

* Plates do not need to be sent in if the plates were transferred to another vehicle

6.  Once confirmation of the withdrawal is received, the dealer may retain the Certificate of Origin in order to resell the vehicle

7.  The dealership must complete an Application for Abatement of Fees and submit it to the Registry for processing
